1) Overview

Welcome to ESCAPER (the “Site”), operated and managed by Vishesh Media in India. Throughout these Terms, “we”, “us”, and “our” refer to ESCAPER. By visiting www.escapercollection.com or purchasing from us, you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and any additional policies referenced here or available by hyperlink. If you do not agree, please do not use the Site. We may update these Terms at any time by posting a revised version on this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

 

2) Eligibility & Your Responsibilities

We may refuse service, limit or cancel quantities, and restrict orders at our discretion, including orders placed under the same account, payment method, or shipping/billing address. If we change or cancel an order, we may attempt to notify you using the email, phone, or billing address provided. You agree to provide current, complete, and accurate purchase and account information and promptly update details (including email and payment information) so we can complete your transactions and contact you as needed.

Certain products or services may be available exclusively online and in limited quantities. We try to display colors and images as accurately as possible; however, display accuracy depends on your device. Prices and product information may change without notice. We may discontinue any product at any time. We do not warrant that products, services, information, or other material will meet your expectations, or that any errors will be corrected immediately.

Prices shown are exclusive of applicable taxes, duties, and shipping charges unless stated otherwise.

13) Disclaimer of Warranties

The Site and all products/services delivered through it are provided “as is” and “as available” without representations, warranties, or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that results will be accurate or reliable.

 

14) Limitation of Liability

To the maximum extent permitted by law, ESCAPER, Vishesh Media, and our directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Site, products, or services, even if advised of the possibility.

You agree to indemnify, defend, and hold harmless ESCAPER, Vishesh Media, and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of law, or your infringement of third-party rights.

 

16) Severability

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be deemed severed without affecting the validity of the remaining provisions.

These Terms remain effective unless and until terminated by you or us. You may terminate at any time by ceasing use of the Site. If we believe you have violated these Terms, we may terminate your access without notice, and you will remain liable for amounts due up to the date of termination.

 

18) Entire Agreement & No Waiver

These Terms, together with policies posted on the Site, constitute the entire agreement between you and ESCAPER and supersede all prior agreements or communications. Our failure to enforce any right or provision is not a waiver of such right or provision.

 

19) Governing Law & Jurisdiction

These Terms and any separate agreements whereby we provide you services are governed by the laws of India. If you choose to visit the Site, your visit and any dispute over privacy is subject to these Terms and our Privacy Policy. In addition, any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.
